Recruitment Scam in KVIB | ** HC dismisses petition filed by ex-deputy CM Mangat Ram | | Early Times Report
Jammu, Feb 9: A high division bench of Justice Muzaffar Hussain Attar and Justice Tashi Rabstan today dismissed a petition filed by ex-deputy chief minister and then KVIB chairman Mangat Ram Sharma, who had challenged the October 26, 2007 order of the J&K State Accountability Commission (SAC), whereby SAC had initiated regular inquiry against him and two ex-secretaries of KVIB - J P Singh and R C Sharma -- for allegedly making appointments in contravention of the service regulations of J&K Khadi Village Industries Board. The bench vacated the stay order issued on November 27, 2007 and upheld the SAC order, paving way for holding a regular inquiry against the former deputy CM and then KVIB secretaries. Mangat Ram's counsel submitted that the allegations levelled in the complaint were vague and he was a public man who had served the state in various capacities with utmost 'dedication and discharged his duties in accordance with law of the land'. He argued that initiation of regular inquiry by SAC against him would adversely affect the respect earned by him. He submitted that while making the appointments in KVIB, he had followed the rules and no illegality had been committed. It was alleged that Mangat Ram, in league with the two secretaries, had indulged in making illegal appointments thereby abusing his official position and also the mandate of Articles 14 and 16 of the Constitution of India as no opportunity was afforded to public at large to respond against the vacant posts in KVIB. It was also alleged that the petitioner had failed to comply with the provisions of law and complaint 'does disclose the allegations as defined in section 2(3) of SAC for initiation of regular enquiry against him. After hearing the counsels, the bench observed that in the peculiar facts and circumstances of the case, the questions which are raised in the pleadings by the parties, would not call for returning of finding and it is for SAC to bring the regular inquiry to its logical conclusion in accordance with law. With these observations, the bench dismissed the ex-deputy CM's petition and vacated the interim directions passed on November 27, 2007, paving way for the holding of a regular inquiry by SAC against him and the two secretaries.
