KU denies info regarding SET exam | | | Asif Iqbal Naik Early Times Report
Kishtwar, Mar 15: University of Kashmir has denied the information under Right to Information Act to the information seekers on the pretext that the information falls under the preview of restriction clause. As per the details available with "Early Times", Jammu and Kashmir State Eligibility Test (JKSET)exam was conducted by Kashmir University in 2013 and subsequently a supplementary result notification was issued by Kashmir university in 2015 in which about 100 more candidates were declared as qualified by the University Authorities. Accordingly two candidates Manish Sharma and Vijay Kumar care Room No. 102, Bawa Jitto Men's Hostel University Jammu filed an RTI before Public Information Officer Kashmir University and demanded copies of old answer keys as well as the modified ones along with Optimal Mark Recognition (OMR) answer sheets of candidates who were declared qualified in supplementary result. But the PIO has denied the copy of OMR sheets citing restriction clause as the cause for denying the information by citing some CIC judgments. The applicants have alleged that there is some foul play in preparation of supplementary result of JK SET 2013 conducted by Kashmir university. The information seekers claimed that info sought by them does not fall under the preview of restriction clause and they demanded that the answer sheets of qualified candidates must be made public in all exams so that no doubts are created about the fairness of result among the candidates, who appeared in such prestigious examination. While rejecting the 2nd appeal of the information seeker, the university officials stated that "As per the CIC decision dated 06-12-2006 passed in case titled Ajay Srivastara Allahabad Vs UPSC New Delhi, copies of answer books cannot be provided due to fiduciary relationship with examiner likewise own answer sheet may be shown to the applicant, but not answer sheets of others" and on the basis of this the 1st appellant authority rejected the application vide order dated 18-12-2015 and accordingly the reason thereof for denying information under RTI Act to the applicant was conveyed to applicants by the 2nd appellant authority through a letter dated 9-01-2016 forcing the applicant to knock the doors of the State Information Commissioner who had directed the Kashmir University Authorities to reply to the notice of the commission by tomorrow. While talking to "Early Times" the information seekers said that Kashmir University authorities are unnecessary causing delay in the providing information sought by them. They said that they are hopeful that they would get justice from State Information Commission. They said that they are hopeful that Commission would issue directions to Kashmir University with regard to providing them the copies of the answer sheets demanded by them. |
