Court imposes Rs 9 lakh penalty on Khyber milk | | | Early Times Report Budgam, Apr 4: A court in this central Kashmir district today slapped a fine of Rs 9 lakhs on Khyber Agro Farms Pvt ltd and awarded six months imprisonment to its nominated after laboratory tests revealed presence of detergent in its tonned milk samples lifted in July 2013. court of judicial magistrate Budgam Imtiaz Ahmad Lone held M/s Khyber Agro Farms Pvt Ltd, Lethpora Pampore guilty by and convicted its in-charge operation (nominated person) Mohammad Shafi Ganie of Larson Ganderbal under section 51 (sub standard), 52 (misbrand) and 59 (unsafe food) of the Food Safety and Standard Act 2006. For sub-standard food, the court slapped a penalty of Rs 5 lakh on the company, Rs 3 lakh for mis-branded item and Rs 1 lakh for unsafe food. For unsafe food, the court imprisoned Ganie to six months imprisonment. The samples were sent to Referral Laboratory Kolkatta that revealed that the sample of toned milk Khyber Brand is sub-standard, un-safe and misbranded. During investigation the proprietor maintained that he had purchased the said milk from M/S Khyber Agro Farms Pvt Ltd, Processors and Packers of Khyber Toned Milk. The shopkeeper was acquitted by the court. "This is not first case where it has come to the surface that the milk product manufactured by the accused company contains detergent, urea and other dangerous chemicals not only in milk but other edible products and in this behalf prosecution has been launched against the accused company and others," the court said, holding M/S Khyber Agro Farms Pvt Ltd Village Ladhoo Lethpora Tehsil Pampore Pulwama guilty. Accordingly, the court convicted the company through its Incharge Operations (nominated person) Muhammad Shafi Ganaie under sections 51,52,and 59 of FSSA 2006 and imposed a penalty of Rs 9 lakhs for sub-standard food, mis-branded item and un-safe food and six months imprisonment to Ganie. "The Commissioner Food and Safety Act is hereby directed to collect the samples of all milk products, oil, ghee and other edible products available in the market in the-name of the convicted company and other companies and shall send it referral Laboratory Kolkata for opinion and action as warranted under law be initiated against the company whose product if declared unsafe, mis-branded and sub-standard or otherwise harmful for consumption," the court added. It also asked the government to remove Hamid Ullah Dar, food analyst Kashmir. "His style and manner of job is not dangerous to the present nation but it is equally dangerous for those who are yet to born and are being subjected to a treatment which they do not deserve. As the Food Analyst of Kashmir is the first judge of the case and in the system of justice there is no place for a person who is either incapable or big dishonest I feel pain to describe how our society has been subjected to silent injury by permitting convicted company to earnprofit at the costs of the lives of the nation only God knows how many people might have died by consuming detergents in the Khyber Tonned Milk," the court added. |
