HC directs state to ban Chinese kite string | | | Early Times Report
Jammu, Apr 4 : A high court division bench of Chief Justice N Paul Vasanthakumar and Justice Dhiraj Singh Thakur today directed forest commissioner to issue order, banning sale-purchase and use of plastic Chinese kite string called 'Manja' in the state within a period of one week from today and monitor its implementation through all the district superintendents of police and SHOs of police stations. The court directive came in a PIL filed by Save Animal Value Environment, an NGO. Earlier, the senior AAG submitted that no SRO or notification had been issued by respondents as assured by the advocate general as on today. The bench, while allowing the PIL, observed that in view non-issuance of notification or SRO inspite of the recommendations made by the state pollution control board to the department of forests, environment and ecology and the fact that due to non-banning of the plastic Chinese sharp kite strings, human beings, animals and birds were put to dangerous situations. Having regard to the fact that ban orders were issued in other states, this court, being protector of lives of humans, animala and birds was bound to grant the prayer as sought for in the writ petition and directed to issue order, banning sale-purchase and use of plastic Chinese sharp kite strings in the state and monitor its implementation through all the district superintendent of police and SHOs of police stations, the bench directed. --(JNF) |
