Dal Lake preservation: HC dissatisfied over non-appearance of CS, others | | | Early Times Report
Srinagar, Apr 6 : A high court division bench of Justice Muzaffar Hussain Attar and Ali Mohammad Magrey today expressed dissatisfaction over the non-appearance of chief secretary as well as commissioner secretaries of finance and housing and urban development department (HUDD) before it. As the hearing of PIL began, the senior additional advocate general submitted that an application had been filed by the chief secretary and other officers for exemption from personal appearance. "We are not satisfied with the grounds taken in the application for seeking exemption from their personal appearance. All these authorities are public servants. The court in this PIL is dealing with the cause of great public importance," the bench said. On last date of hearing, the bench had thought it proper to have a permanent mechanism for preservation of water bodies and accordingly directed the authorities to remain present before the court today. "This PIL has taken a lot of public time. As observed in the previous court order, the desired results have not been attained till date. This court cannot afford to keep this petition alive for all times to come," the bench said and observed that court would have to initiate action in accordance with law against these authorities but in view of the request by senior AAG, initiation of proceedings against them is deferred," the court said and adjourned the PIL till next week with a direction to registry to list it on week commencing from April 16. "On next date of hearing, all the authorities shall remain present before the court," the bench said. Joint Secretary of Union Ministry of Tourism and Culture was also not present as was directed by the court. Assistant Solicitor General of India submitted that he could not appear because information was send to him late. "The said authority shall also remain present on next date. The other officers who are present today shall also remain present," the court added. In another direction, hotel Grand Palace was granted a week's time to take remedial steps for reducing bio-chemical oxygen demand which according to pollution control board is in excess of the permissible limit. "It is also mentioned that TSS is also in excess than the permissible limit," the court observed. The court also directed the PCB by the end of present week to take fresh samples from the STPs and submit fresh report before next date. "In respect of hotel Centaur Lake View, PCB, in its compliance report, stated that the samples collected on March 14 were conforming to prescribed norms. However about STP at SKIMS Soura, it is reported that Bio-chemical oxygen demand was found in excess than the prescribed limits," the bench said. |
