HC declares woman as panch, imposes Rs 1 lakh cost on 'respondent' | | | Early Times Report
Jammu, Apr 6: High court judge B S Walia, while imposing the cost of Rs 1 lakh on state functionaries, allowed the writ petition of one Janko Devi and declared her as panch of Sheikpura in panchayat Halqa Kathar, Bishnah. Earlier, the petitioner's counsels submitted that she had filed her nomination and respondent Sunita Devi had not annexed the documents as required in terms of rule 9-C of the rules on the date of scrutiny. They said petitioner was the only validly nominated candidate at that time, but the returning officer of Bishnah block included the name of Sunita despite the fact that Janko was the only candidate at the time of scrutiny. After hearing them, Justice Walia allowed the writ petition and declared Janko as panch. He also directed the official respondent to pay the cost of Rs 1 lakh to petitioner within four weeks from today. "After noticing the dilatory tactics of respondents in not filing the reply nor producing the record before the high court for around four and a half years, it is in the interest of justice to direct the state to lay down guidelines for its officers with regard to the time frame within which a reply is to be prepared and filed in the court on receipt of notice and in case of the failure of officers to adhere to the time frame for preparation and filing of reply and also production of the record as per directions of the court, the concerned officials responsible be made accountable and appropriate action be taken in respect thereto as per law," the court ordered.
