Jammu, July 5: 1st additional sessions judge, Jammu, M A Chowdhary today rejected the bail application of an alleged nacro-smuggler. As per police report, applicant Mohammad Shakeel along with one Purshotam Singh, son of Surjeet Singh of Balhote, Ramban, was apprehended by a police party after a chase from Shastri Nagar chowk near cremation ground here at about 1 pm on June 5, 2016. 70 corex bottles were recovered from Shakeel and 76 from Purshotam. Both of them were arrested and booked at Gandhi Nagar police station under section 8/21/22 of NDPS Act. The judge, after hearing the two sides, observed that the rigour of section 37 of NDPS Act had to be applied with all harshness and commercial quantity of the psychotropic substance had been allegedly recovered from applicant, who was arrested for the commission of offence punishable under section 21/22 of NDPS Act, which entail sentence to rigorous imprisonment and may extend to 20 years and fine upto Rs 2 lakh. "Investigation of the case has not been completed so far and there is no material before this court to record its satisfaction that the accused has not committed the offence. In the considered opinion of this court and in view of the gravity and nature of the alleged offence which entails maximum punishment on conviction, application is found without merit and substance and is liable to be rejected. In this backdrop of the matter, the application moved by the applicant for enlargement on bail is hereby rejected," the judge ordered. (JNF) |
