| Allow inspection of records: SIC to PHE division Doda | | | Early Times Report
Jammu, July 5: The State Information Commission (SIC) has given direction to Public Health Engineering (PHE) Doda to allow inspection of records by a Doda based RTI applicant as the information seeker wanted some vital information about Padder-Zagrali Kuluhand water supply scheme which was executed few years back by the PHE division Doda. The information seeker had prayed before SIC that he was denied information about this scheme by the PHE division Doda.
As per details available with Early Times a second appeal under section 16 of J&K RTI Act 2009 was filed before State Information Commission (SIC) by one Mohammad Ishaq Bhat R/O Dali Kuluhand , Doda on 29.03.2016. Appellant stated in his appeal that he filed RTI application before Executive Engineer PHE Division Doda who is also the Public Information Officer (PIO) under J&K RTI Act 2009 on 15.12.2015. According to appeal said PIO returned his RTI application in original raising objections, which were not genuine. After filing of First Appeal before SE Hydraulic Circle Doda , who is the First Appellate Authority (FAA) , Mohammad Ishaq Bhat (appellant) received a call on 04.02.2016 from JE asking to visit PHE division Doda for inspection of record which he did not agree as it was very difficult to inspect all the record in a short span of time as he required the information in hard copies for his satisfaction.
Executive Engineer PHE Doda (PIO) in his letter dated 01.02.2016 informed Mohammad Ishaq that information sought by him is quite voluminous and would disproportionately divert the resources of the public authority, whereas he has only sought information of one water supply scheme.
Further, PIO asked him to mention name of the water supply scheme. Appellant alleges that it was non- seriousness of the said PIO towards the Act as PIO wanted to hide the information. Accordingly, appellant filed 2ndappeal before the State Information Commission (SIC) and requested the Commission to take further action under the Act regarding this case.
As per records, appellant vide RTI application dated 15.12.2015 sought information regarding Padder-Zagrali Kuluhand water supply scheme under PHE Division Doda. Information seeker sought details such as total length of said pipeline, total pipes used, indent, estimates, work done estimate, survey report, technical sanction, name of work supervisory staff appointed from time to time, copies of M. Book, tendered work, departmental work, copies of allotment, name of executing agencies, payment details viz. Cheque number . dated/amount, invoice detail for departmental works payment, muster sheets etc. The RTI application according to PIO has been responded to by PIO/Xen PHE Doda vide letter dated 01.02.2016 informing the applicant that the information sought by him was quite voluminous, which would disproportionately divert the resources of the public authority. PIO has accordingly requested the applicant to attend his office for inspection of the record in person or through authorized representative on 04.02.2016.
In its order, SIC ruled, "PIO is directed to intimate date and time for inspection of information to the appellant either in the afternoon or forenoon and allow appellant take relevant extracts of the information/records inspected. A compliance report in this regard be submitted to the Commission". |
