SVC seeks personal appearance of Director Floriculture in shop allotment at Cheshma Shahi

Jammu, July 12: The full Bench of State Vigilance Commission (SVC) comprising of Kuldeep Khoda, Dr R K Jerath and Smt Gous-ul-Nisa Jeelani has summoned the Director Floriculture for his personal appearance before the Commission on next hearing on August 2 and to explain the reasons of inaction on his part in a complaint lodged before the Commission by one Sheikh Nyeem Ahmad, regarding illegal occupation of a shop outside Cheshma Shahi Mughal Garden.
The complainant on the basis of information obtained under RTI from Floriculture Department has alleged flouting of procedure in occupation of a shop belonging to Floriculture Department situated outside Mughal Garden, Chesma Shahi under the name and style of "Tourist Photo Studio" by one Mohd. Amin Pahloo.
"The perusal of the records revealed that the shop in question was occupied by Mohd Amin illegally without any agreement with the department and in the year 1979," said Mohd Amin approached Civil Court with the suit for perpetual injunction against Floriculture Department and others with the prayer not to evict him from suit premises.
Later the court vide judgement dated 22/03/2007 issued directions not to evict the said Mohd Amin from suit shop without following due procedure under law.
"Despite court decree passed in 2007, same was not agitated by the Floriculture Department before the Higher Court, and Government interests not protected, with the result that the said shop continues to remain under occupation of the said person resulting huge loss to state exchequer. The said occupant was neither evicted nor has he paid any rent to the concerned department, and the Floriculture Department continues inaction which has resulted into a huge loss to the State exchequer.
During its sitting the full bench of SVC directed the Director Floriculture to appear in person and to explain the continued inaction by him and the administrative department for several decades.
