HC’s directive in PIL against pollution caused by cement factories | | | Early Times Report Jammu, July 13: A high court division bench of Chief Justice N Paul Vasanthakumar and Justice Tashi Rabstan today said if a person "approaches pollution control board (PCB) or any other authority for setting up a cement plant, it would, before granting permission, shall satisfy itself with regard to the location as to whether its establishment will cause pollution because it is not conducive to set it up in a populated area". The court directive came in a PIL filed residents of Mantaki and Seerbagh colonies of Khrew, alleging that a huge industrial pollution was being caused by the cement plants which do not adhere to the prescribed norms. The bench, after hearing both the sides, observed "it is made clear that if any person approaches PCB or any other authority for setting up a cement plant, before granting permission or consent, the authorties as well as PCB shall satisfy with regard to the location as to whether establishment of a cement plant will cause pollution for inhabitants as it is not conducive to set it up in a thickly populated area". The bench also directed that permission may be granted only if the proposed plant was at an isolated place where inhabitantion was very less and such request could be considered and permission/consent may be granted only after observing all the legal requirements of controlling pollution level. |
