Jammu, Sept 8: In a petition, seeking quashment of order whereby respondents were posted as Designated Officers in Food & Drugs Department, high court judge Janak Raj Kotwal has stayed the impugned order with a direction to respondents to accord consideration to the petitioner's representation said to have been filed earlier by him. The petition has been filed by Farid Ahmed Beigh. After hearing his counsel, Justice Kotwal observed that the September 3, 2011 order No FSAJK/112 'shows that 23 Food Inspectors (executive) were appointed as Designated Officers, one for the entire state and 22 in each of the districts'. These appointments seem to have been made in order of seniority of Food Inspectors in the seniority list issued vide the April 19, 2010 notification. One Shallu Ram is the last person in order of seniority and figures at serial No 21 followed by the petitioner, who figures at serial No 22. Vide order No 04-CFS of August 3, 2016, Zamer Ahmad, respondent No 3, who figures at serial No 41 in the seniority list is appointed as Designated Officer for Kulgam district. "Here arises the grievance of the petitioner and he claims that being next in the seniority, he should have been so designated," the court observed. (JNF) |
