Jammu, Oct 1:: Fast Track Court Presiding Officer Kishore Kumar today rejected bail application of a BSF cop in an alleged rape case. BSF cop Mukesh Kumar was arrested by police last month following his alleged involvement in a rape case. The victim, originally a resident of Balote in Dudu Basantgarh area of Ramnagar, is at present residing at Patoli here. In her complaint lodged with police on August 7, 2016, she said was pursuing higher studies and doing a private job to support herself. She was earlier putting up at Bagh-e-Bahu where Mukesh also lived. Since he used to chase and pressurise her to marry him, she rejected his proposal and shifted to Patoli, she alleged. She alleged that Mukesh came to her room at Patoli at about 2 pm on August 3 when she was all alone in the house and committed rape on her, threatening to kill her if she raised her voice. Taking cognizance of her complaint, police booked the accused under section 376 of RPC and arrested him. After hearing both the sides, the court observed that offences of abduction and rape were the most serious offences against women. These offences have been viewed as offences against society as a whole and letting the accused on bail in such offences, if prima facie appears to be committed, would definitely have deleterious affect on the mind of the general public and would encourage re-occurrence of such crime. With these observations, the court rejected the bail application of the accused. (jnf) |
