HC directs state to file status report
PIL seeking establishment of Eye Bank

Jammu, Oct 5: : A high court division bench of Chief Justice N Paul Vasanthakumar and Justice Janak Raj Kotwal has directed the state to file status report on the follow up action taken by it for the establishment of Eye Bank.
The court directive came in a petition seeking setting up of Eye Bank. It has been submitted in the PIL that the only eye bank operating in the state was closed by respondents in 1994 and no eye bank or eye donation center had been functioning since then in J&K. It was stated that a huge blind population and those receiving eye injuries had to go outside the state at huge expenses and times. The right to public health and medical care has been held to be one of the facets of the Article of the Constitution of India.
It has been further submitted that mockery of the decimal scenario of J&K is glaringly manifested as first eye bank in world was established in 1944 and in India too, it was established 1944 at Madras.
34,589 eyes were collected and 13,887 eye transplants were performed successfully in India in 2008 with nil activity in J&K for the past 18 years. The respondents have ample funds at their disposal to establish and operate at least one eye bank in each capital of the state as crores of rupees of medical grant from the Government of India was being utilized up to less than 5 per cent only. A direction was sought to the state and its functionaries to establish at least one eye camp in the cities of Jammu and Srinagar.
The health secretary had on August 8, 2016 filed the status report, wherein it was stated that the respondent had now released the entire remaining amount of Rs 89.70 lakh on August 4, 2016 for the establishment of Eye Bank at the government medical college, Jammu. This excludes the cost of ambulance, which is being separately procured and provided to the Eye Bank by the department. The total release thus made for setting up of Eye Bank at GMC, Jammu, during 2016-17 is Rs 130.95 lakh.(JNF)
