Early Times Report Jammu, Dec 6: Principal sessions judge, Kathua, Vinod Chatterji Koul has rejected the bail application of a woman who had allegedly had thrown acid on her husband. Shamim Akhter (40) had allegedly thrown acid on her husband Mohammad Din of Chalog in Bani area of Kathua. According to the police, a case against the petitioner is registered at Bani police station under sections 341, 326-A and 34 of RPC. As per the report, she had thrown acid on her husband, resulting in serious injuries to him. "The investigation of the case is at initial stage. Petitioner is absconding after the commission of offence and her custodial interrogation is required for the purpose of investigation," the court observed. The court, after hearing both the sides, observed that the provision of bail under section 497-A of CrPC was not available to the person accused of offences mentioned in section 497-C (1) of CrPC. "Offence punishable under section 326-A of RPC falls within such mischief, as such, application under section 497-A CrPC is not maintainable. Therefore, in view of the bar created by Section 497-C (3) of CrPC, this application is held to be not maintainable and is accordingly rejected," the court ordered. |
