HC forms panel of DC, SSP; orders sealing of illegal constructions in Gulmarg

Srinagar, Dec 6: The State High Court has formed a committee of Deputy Commissioner and Senior Superintendent of Police, Baramulla to ensure no illegal constructional activities are carried out at Gulmarg.
Hearing a Public Interest Litigation, a division bench of Justice M H Attar and Justice B S Walia directed the committee to seal the structure in case illegal construction is figured out on the spot.
The court directed the panel to file latest status report about the visit and any kind of illegal constructions by or before the next date of hearing in the PIL.
The court has also received the record from trial court pertaining to Gulmarg Land Scam which came to light in 2009 after Vigilance Organisation Kashmir (VOK) registered an FIR against some top officers of the state and some hoteliers of Kashmir for alleged grant of ownership of State land duly transferred to Gulmarg Development Authority.
On last date of hearing, the court had observed that the laws have to be implemented without any deviation and breach.
It expected apology by CEO Gulmarg Development Authority for issuing permissions for repairs and renovations of hotels in Gulmarg, the world famous tourist record.
The high court has already stayed all permissions for repairs and renovations of hotels in world famous tourist resort.
The CEO GDA had filed compliance report in terms of the court order on October 18 and stated that he has issued the permissions to the hoteliers in good faith and pursuant to recommendations made in the report of court commissioners. He also stated that he was under his bonafide belief that the court order dated 22.9.16 authorized him to issue such orders and that matter need not to be place before the BOCA.
He had stated compliance report that all these permissions have been kept on hold and the position, existing as on 5 October was maintained. The carriage of material was also not allowed to be transported, he had said.
In future, he said to remain alive to the importance of his job, duties and responsibilities and will perform his duties strictly in accordance with the court orders as well as rules and regulations.
The PIL was filed in 2012 by one Mohammad Rafiq Zargar, seeking directions to save the Gulmarg and Tangmarg, the world famous tourist resorts, from encroachments and pollution.
