Chairman JCCB challenges jurisdiction of Registrar Coop Societies; manages stay | | | Sumit Sharma JAMMU, May 8: In a dramatic turn of events, Mohinder Singh, who was elected as the chairman of the Jammu Central cooperative bank the previous day only to be sacked eventually and the administration of the bank was handed over to a Government appointed administrator, today regained the chair after he secured a stay order from the court against the Government move. The Judicial Member Jammu and Kashmir Special Tribunal, Jammu stayed the order No RCS/LS/566-568 passed by the Registrar Cooperative Societies, J&K, Srinagar whereby he ceased the powers of Board of Directors of Jammu Central Cooperative Bank Limited Jammu and appointed Joint Registrar (Admn) Cooperative Societies, J&K to look after the affairs of the bank. The order followed a complaint of violation of the Cooperative Societies Act which was filed by Multipurpose Cooperative Society Muthi Rakwalan district Kathua through its President claiming that election had been conducted without prior knowledge of the society and without proper publicity. He further claimed that the election had been conducted by flouting all the norms. The court gave respite to the Mohinder Singh after he challenged the jurisdiction of Registrar Cooperative Societies J&K. The court after hearing the counsels stayed the order till objections were filed by the respondents. Meanwhile, a handout was issued by the Jammu Central Cooperative Bank Limited in which the bank management raising finger against the Registrar Cooperative Societies said that instead of providing an opportunity of being heard, he virtually decided the petition one sided and passed an order in the mandatory form whereby the powers of the elected Board of Directors were ceased and an administrator was appointed accordingly. Pertinent to mention here that Chairman of the bank namely Mohinder Singh allegedly bypassing all rules and act of the society, got the elections held in the four walls of his official chamber at Sehkari Bhawan, Bahu Plaza after he called some of his confidential member societies and returning officer namely Bhati of Ramgarh and declared himself elected. However, the matter is subjudice and the court fixed the next date of hearing on May 23, 2014. |
