Principal, Under Secretary face music for delay; violating RTI Act 2009 | Details of sexual harassment in GCW, Parade sought | | Sumit Sharma
Jammu, July 6: Unaware of the JK RTI Act 2009, the Principal Women College Parade allegedly asked the information seeker to pay the requisition charges of Rs 34 that too beyond the time limit of 30 days, which forced the information seeker to file appeal before the Special Secretary Higher Education Department, Civil Secretariat who happens to be the First Appellate Authority (FAA), which is still undecided. However, Chief Information Commissioner G.R. Sufi rebuked FAA for his laxities and also sought explanation from the then PIO Javed Ahmed Reshi, Under Secretary that why penalty should not be imposed against him for delay to provide information to the information seeker. The Commission took both the Professor and bureaucrat on cudgel following the second appeal filed by Kovid Khosla; advocate, before the Commission alleging inaction of Public Information Officer/Principal Women Parade, Jammu Hemla Aggarwal and Under Secretary Javed Ahmed Reshi to address his RTI application. Khosla filed RTI to GCW Parade, Jammu seeking details of complaints of sexual harassment viz-a-viz Teacher-teacher/student-teacher/employees-employer including non teaching staff received by GCW management since 2005, steps taken by GCW management to address the issue of sexual harassment of women employees/students in college as per guidelines by Supreme Court of India, any committee constituted to inquire into such complaints and kind of action taken if any. Though the appeal routed through 4 functionaries of the department, but after the elapse of six months the information seeker got nothing even he knocked the door of the FAA. Disposing of the appeal, the SIC observed, "The appellant did file RTI application before PIO/Principal Women College Parade Jammu on 28/11/2013 seeking information as listed in the RTI application. The PIO/Principal Women College Parade , Jammu stated that as she was not declared PIO at that time and she was Asstt. PIO as per government order. The Principal GCW Parade as APIO forwarded this RTI application to the PIO Higher Education Department Civil Secretariat. Thus she has taken action within time as prescribed under the Act. Therefore, the order in any case was to be passed by the Under Secretary Higher Education Department. There is no cognizable action against Principal Women College, Parade. It is again seen from the records that Rs 34 were asked from the information seeker as copying charges. However, requisition of such charges has been made beyond time limit of 30 days as provided under the Act. Accordingly it seems that the Govt, Authorities later on did not insist on such payment and information was provided to the information seeker in full vide dated 3.1.2014 and 3.6.2014. The then PIO Javed Ahmed Reshi, Under Secretary is directed to explain why information was not provided to information seeker in full within the time laid down under section 7 i,e 30 days. His explanation, if any, should reach this Commission within 30 days for not imposing penalty against him. The present PIO Mohd Reyaz to serve a copy of this order to his predecessor". |
