Justice (R) Khan to head SAC, Nazki SHRC

Jammu, April 10: The State Accountability Commission as well as the state Human Right Commission are all set to get the Chairman shortly as BJP-PDP government has decided to fill up the posts shortly.
Pertinent to mention out of six commissions, five commissions set up by the Jammu and Kashmir government are "headless" as the post of chairman in these commissions is lying vacant, while all positions were vacant in four of these commissions.
As per the sources, the State Accountability Commission that has been constituted under Jammu and Kashmir Accountability Commission Act, 2002 to inquire into grievances and allegations against public functionaries and for matter connected therewith is all set to get the chairman this month as the government has finalized the name of Retired Chief Justice Bashir Ahmed Khan for the post of the Chairman, while according to the sources the name of Justice Retired Chief Justice of Andra Pradesh High Court Bilal Ahmed Nazki has been considered for the post of Chairman State Human Right Commission. After serving as High Court judge for nearly 9 years, Justice Khan served as the Chief Justice of J&K High Court from 25-01-2007 to 31-03-2007 while Justice Bilal Ahmed Nazki Was appointed as Hon'ble Judge of High Court of J&K on 06.01.1995 and worked as such upto14.10.1997. Was transferred to High Court of Andhra Pradesh on 15.10.1997 and was appointed as Acting Chief Justice of High Court of Andhra Pradesh on 04.04.2005.
The sources said that after careful thought and keeping in view of the integrity of both the judges during their service times, the Law Department finalized the names of these two judges for the prestigious institutions of the state and according to the sources, the announced of the names of both the judges will be made after completion of all the formalities as according to section 4 of the Jammu and Kashmir Accountability Act, the Chairperson and the Members are to be appointed by the Governor after obtaining the recommendations of a Committee consisting of the Chief Minister, the Speaker of Legislative Assembly, the Chief Justice of the State High Court, the Law Minister and the Leader of Opposition in the Legislative Assembly.
The sources added that in order to accommodate these two judges, the government make amendment in the existing law which now allows the government to appoint retired judges for the post of Chairman up to age limit of 75 years, which was previous 70 years. The Sources said that due to shortage of retired judges within the state, the government is also considering appointment of judges from outside state for Chairman Posts; however it is not easy job for the government to convince non state judges to hold the posts.
It is pertinent to mention that CM Mufti Mohammed Syed recently stated that all positions in the J&K Public Service Commission, J&K Accountability Commission, J&K State Human Rights Commission, J&K State Commission for Women, including that of the chairman are vacant, adding that "the government is committed to revive all these institutions and provide them with adequate administrative support and manpower for achieving the desired results as per the constitution acts under which these commissions are constituted". He said that state accountability commission has received complaints against eight politicians, where as the State Vigilance Commission received 2,327 complaints against bureaucrats and government employees out of which 1,404 complaints were disposed off and 923 were pending.
