DB directs State to complete DGPC elections before July | | | Early Times Report
Jammu, Apr 10 : In a contempt petition filed against Shantmanu, then Divisional Commissioner Jammu and Financial Commissioner Arun Kumar Financial Commissioner Jammu for not holding the Elections of District Gurudawara Parbandhak Committee Jammu, A Division Bench of State High Court Comprising Chief Justice N Paul Vasanthakumar and Justice Dhiraj Singh Thakur after hearing Sr. Adv KS Johal with Adv Ashray Choudhary for the petitioners whereas AAG HS Siddiqui appearing for the State observed that as per revised schedule announced, and the assurance given to complete the election by 8.7.2015, and having regard to the fact that the election could not be conducted due to the reasons stated supra i.e., within six months, we are of the view that there is no willful disobedience to punish the respondents. However, it is made clear that the revised schedule as extracted supra shall be strictly adhered to and if the election is not completed by 8.7.2015 as per the revised schedule, the Divisional Commissioner shall not continue to manage the affairs of the District Gurudhwara Prabandhak Committee, Jammu. Division Bench further observed that this order will not preclude the petitioners in approaching the Government seeking nomination of a Committee in terms of Rule 63(c) and if any such representation/application is submitted by the petitioners before the competent authority, the same shall be considered and disposed of within a period of six weeks from the date of receipt of copy of such representation/application. With these observations Division Bench closed the contempt petition. (JNF) |
