LA Recruitment Scam: HC rejects closure report of SVO, directs fresh probe

Jammu, Apr 16: In a significant order Justice Janak Raj Kotwal of J&K High Court today rejected the closure report of State Vigilance Organization (SVO) in Legislative Assembly (LA) Recruitment Scam with further directions for reopening of the probe and directed the SVO to restart the probe into the complaint alleging 37 illegal/backdoor appointments in J&K Legislative Assembly and MLA Hostel Jammu/Srinagar.
Justice Kotwal further directed the SVO to complete the probe within two months and further directed the SVO to file the compliance report in this regard and directed the registery of the High Court to list this petition in the month of May for further proceedings.
When the petition came up for the hearing in the Court of Justice J R Kotwal, counselor appearing for the petitioner submitted that the big sharks were let off by the SVO in the recruitment scam in the J&K Legislative Assembly where the then Speaker Muhammad Akbar Lone in connivance with Secretary J&K Legislative Assembly Muhammad Ramzan appointed thirty-seven blue-eyed candidates against the newly created posts which were created vide Cabinet decision number 197/14 dtd 23/2007.
Counselor appearing for petitioner further submitted that no doubt under rules eight and nine of J&K Legislative Assemble Secretariat (Recruitment and Conditions of Service) rules 1959 Speaker is the competent authority for making appointments but the then Speaker resorted to pick and choose policy.
He further contested the SVO closure on the basis of a communication received from Assembly Secretariat wherein it was submitted that Speaker is a competent authority and some posts were filled up by promotions and other posts were filled up under Rule 8 of the 1959 Recruitment Rules.
On the other hand, Senior Additional Advocate General Gagan Basotra defended the closure of the case on the grounds that it is a service matter and the provisions of prevention of corruption act are not attracted in the instant case. He further submitted that petitioner has no locus standi to file the present petition.
After hearing both the parties, Justice Kotwal in the open court rejected the closure report of the Vigilance and ordered for fresh probe by the SVO with a deadline of two months from today.
