After beef tow; Article '35 A' Likely to generate political heat | Kashmiri organizations team up to fight PIL against Article 35 A | | Javaid Naikoo Early Times Report
Srinagar, Oct 11: At a time when beef row is hitting stands across the state, Kashmir civil Society has set on fire another issue by joining hands with Bar Association of Kashmir to fight a PIL filed by one NGO seeking to undo Article 35 A of the Constitution granting special status to Jammu and Kashmir. After three Hour round table conference of Civil Society members, columnists and Doctors here today, Kashmir Civil Society for Development Studies (KCSDS) decided to support Kashmir Bar Association which has already announced to fight a PIL filed by an NGO seeking repeal of Article 35 A of the constitution. The issue surfaced after very recently one Delhi based NGO functioning under the banner of 'Jammu and Kashmir Study Centre' claimed that article 35 A was discriminatory. Though PIL is pending before the Supreme Court, the NGO in its repeated statements to the press said that it wants its abrogation to end discrimination on certain grounds. Civil society members informed that they will also launch a campaign to inform common masses about the development at ground level to sensitize the people about the consequences of the abrogation of Article 35 A in the long run. Members alleged that the issue of 35 A rocked the just concluded Autumn session of state Assembly but the Speaker Kavinder Gupta denied a debate on the issue citing the sub-judice nature of the issue. They also in round table conference alleged the state government has not assigned the case to any lawyer so far, instead Jammu and Kashmir is represented in the Supreme Court by two lawyers and both are Bhartiya Janata Party (BJP) nominees. Members alleged that the very act of filing writ petition for the brogation of Article 35 A is a conspiracy to change the demography of Jammu and Kashmir by opening the flood gates of permanent entry points into Kashmir. The civil society is raking up issue to fight PIL in the Supreme Court at a time when Beef row is on stands across the state and PDP-BJP coalition government are in a tight situation both at Jammu and Kashmir divisions to handle government affairs across the state as per need of the hour. Notably as per legal experts Article 35 A of the constitution of India protects state subject law in Jammu and Kashmir, besides other basic rights of state citizens, but as per office bearers of Jammu and Kashmir Study Centre, an NGO operating from Delhi, the act allows Jammu and Kashmir to grant special privileges and rights to its permanent residents and denies the same to several others who too have genuine claims, therefore wants its abrogation. |
