CEOs , ZEOs fail to submit annual property statements

Srinagar, Oct 11: The Chief Education Officers (CEOs) and Zonal Education Officers (ZEOs) of School Education Department Kashmir have failed to submit their annual property statement before the competent authority for the last 3 years .
The matter has come to public domain after the said information was provided under Right to Information Act (RTI) by the Chief Education Officer (CEO) Srinagar to an information seeker Dr Mushtaq Ahmad Khan from Srinagar.
A copy of the RTI reply which is available with Early Times reveals that all the CEO's and ZEO's of Kashmir division haven't submitted their Annual Property Returns from 2012 to 2014 ie three years.
The reply from Chief Education Officer (CEO) Srinagar reads as : " As per the records available with the office none of the CEO's , ZEO's has filed their Annual Property Returns from 2012 to 2014"
The non submission of Annual Property Return by the civil servants is considered to be an offence under Jammu & Kashmir Government Employees Conduct Rules 1971 and it is duty of every employee (except class IV employees) to submit the annual property returns before their respective head of the departments (HoD's).
The Rule 9 of the J&K Govt Employees Conduct Rules 1971 reads as :
"Every Government employee shall on his first appointment to any service or post and thereafter at such intervals as may be specified by the Government, submit a return of his assets and liabilities in such form as may be prescribed by the Government giving the full particulars regarding " (a) the immovable property inherited by him, or owned or acquired by him or held by him on lease or mortagage either in his own name or in the name of any member of his family or in the name of any other person; (b) shares, debentures, cash including bank deposits inherited by him or similarly owned, acquired or held by him; (c) other movable property inherited by him or similarly owned, acquired or held by him; and (d) debts and other liabilities incurred by him directly or indirectly"
Reliable sources say that CEO's and ZEO's from Jammu division too are not abiding by these rules are majority of them have also not submitted their Annual Property Return before the Director School Education Jammu.
"I appeal Director School Education Kashmir Dr Shah Faesal who is an upright officer to look into this matter and ensure all the CEO's ZEO's plus other employees submit their Annual Property Returns and the same be uploaded on Directorates official website "said Dr Mushtaq Ahmad Khan a member of Jammu Kashmir RTI Movement who obtained this information from School Education department recently. Pertinently that Directorate of School Education Kashmir is uploading all the important orders and circulars on its official website / facebook page on daily basis since Dr Shah Faesal took over as Director School Education Kashmir.
" We hope Annual Property Returns of all employees are also proactively uploaded on the official website / facebook page by the director school education Kashmir. Irony is that most of the employees especially the teachers / lecturers are not aware about annual property statements and the headmasters / principals have hardly instructed his staff about filing it. I suggest Directorate must undertake an awareness about this issue so that all employees abide by this important Government ruling " said Dr Raja Muzaffar Bhat RTI Activist
It is in place to mention here that during December last year when some KAS officers were inducted into IAS there were officers who had not submitted their Annual Property Returns while as few of them were posted as Deputy Commissioners in Shopian and Kishtwar that time. Early Times had filed a detailed report on that issue which prompted the PDP-BJP Government to transfer them to some unimportant posts.
The Department of Personnel & Trainings (DoPT) under PMO has taken the matter related to submission of Annual Property Returns very seriously and all the IAS officers have been directed to submit the same within stipulated time. These returns are available on DoPT's official website also and anybody can access them online.
