Save Dal: HC directs LAWDA to attach 7 illegal structures | | | Early Times Report Srinagar, Oct 17: The J&K High Court has directed Lakes and Waterways Development Authority (LAWDA) to attach seven structures which have been found to be illegal by two court-appointed vigilance commissioners. Hearing a Public Interest Litigation, a division bench comprising Chief Justice N Paul Vasanthakumar and Justice Hasnain Massodi directed the LAWDA to attach the structures by October 27 and also initiate action these constructions as warranted under rules. "The latest report submitted by court vigilance commissioners is shocking to say the least. The report identifies the constructions unauthorizedly raised in recent past in violation of Master Plan, permission granted by BOCA as also directions passed by this court from time to time," the court said. It directed the Superintendent of Police (Srinagar East) and Station House Officers of all concerned police stations to extend cooperation to the LAWDA in ensuring implementation its directions. The structures identified include a double storied construction by Directorate of Indian Medicine (AYUSH) at Harwan, a hut at Bahrar along Nigeen Lake by one Rouf Ahmad Shangoo, a concrete double storied guest house on bank's of Nigeen lake, a restaurant on island inside the lake, a wooden structure to serve as a dining hall to his houseboat by one Abdul Rashid Doonu, a tin shed and a concrete structure at upper compound of a shrine near Nehru Park, and a concrete commercial complex by Mohammad Tariq Reshi of Ishber, Nishat. With regard to shifting of houseboats from Dal to a place called Dole Demb, the government submitted that important steps have been taken in this regard. Advocate General J I Ganie submitted that the project involving shifting of the houseboats from the present location to Dole Demb stands approved by Planning and Development Department as also Finance Department and is to be shortly placed before the Cabinet for final approval, where after steps are to be taken for implementation of project on ground. He also produced a cabinet memo in this regard which was prepared on October 8. "Let the matter be placed before the Cabinet in its next meeting so that final approval is accorded before the adjourned date and compliance reported accordingly," the court said. The court also hoped that first batch of 76 houseboats as stated on September 24, 2014, would be shifted to Dole Demb area as per schedule. "Respondent authority on September 24, 2014, was directed to notify in advance proposed phase-wise schedule of shifting of houseboats to Dole Demb area with sufficient details, so that houseboats' owners may be made aware of schedule well in advance, enabling them to organize their affairs accordingly," the division bench said. "The advance publication of schedule would also rule out last minute objection or impediment in timely implementation of scheduled. Let shifting schedule with particulars of houseboats to be shifted be published in a local daily, immediately after the project finds approval by Cabinet." In another direction, the court directed government to provide a vehicle to the court commissioners, enabling them to discharge their duties. Meanwhile, police informed the court that a proposal to install CCTV cameras at appropriate places around the Dal lake area as to check the transportation of unauthorized building material is under consideration. "We hope that a decision in this regard would be taken well before next date of hearing and effort made to install CCTV cameras at identified places," the division bench said and listed the PIL, filed in 2002 by a then law student, on October 27. |
