HC directs AAG to submit inquiry report within 4 weeks | PIL for probe into 724 kanals land owned by SRK Associates at Sunjwan | | Early Times Report Jammu, Nov 3: In the PIL highlighting alleged hushing up of Chatta Sunjwan land scam, a high court division bench of Justice Dhiraj Singh Thakur and Justice B S Walia has directed the additional advocate general (AAG), who appeared for the state revenue commissioner, to file the inquiry report before the court within four weeks with regard to the probe ordered by his department vide October 7, 2015 government order No 151-Rev (S) with regard to alienation of 724 kanals of land at Sunjwan to SRK Associates allegedly in contravention of the ceiling limit prescribed under J&K Agrarian Reforms Act, 1976, Big Landed Estates Abolition Act and other land laws governing the field. The bench also directed the senior AAG and an advocate, who appeared for GAD, to file their response before next date to MP No 4/2015, seeking appropriate action against all those officers/officials of JDA who had miserably failed to take action against SRK Associates and Ram Kumar, son of Paras Ram (partner of SRK Associates) on the directions of Housing and Urban Development Department issued vide No U&D/15/2008/JDA/AS-32 dated February 5, 2008 whereby then JDA VC had been directed to take further necessary action to put on hold the building permission granted in favour of SRK Associates. The petitioner's counsels drew the attention of the bench towards the October 7, 2015 government order No 151-Rev(S) whereby the revenue secretary had appointed SDM, Jammu (South), as inquiry officer to probe into the alienation of 724 kanals of land at Sunjwan to SRK Associates in violation of J&K Agrarian Reforms Act and Big Landed Estates Abolition Act. It was submitted that the time of 15 days given to the inquiry officer to submit his report had already expired. The land is in the shape of Ghair Mumkin Khud, Banjar Qadeem and slope. SRK Associates' counsel submitted that he had already filed the detailed reply to MP No 4/2015 and sought adjudication of the matter. He levelled serious allegations against the petitioner and submitted that the scope of the PIL be not enlarged as the petitioner had raked up the issue of excess land just to thwart the disposal of the main petition. He submitted that the PIL which is abuse of process of law may be dismissed with heavy costs. He also submitted that the petitioner had filed many such petitions just to gain publicity and the petitions were resulting in wastage of court time and causing harassment to innocent people like SRK Associates. He submitted that because of this 'PIL Industry' many genuine litigants were suffering as their cases were not being heard because of consumption of time in hearing PILs. After heated arguments from both the sides, the bench issued directive to file the inquiry report within four weeks and directed the senior AAG and the counsel to file their response to MP No.4/2015 before the adjourned date of hearing. |
