Jammu, Nov 3: Principal Sessions Judge, Samba, M L Manhas has rejected the pre-arrest bail application of Sajar Din, Jattu, Chattu, Bhaghia and Kalia who were booked by Samba police station in a case of gangrape.
The judge, after hearing the public prosecutor for the state and counsels for the accused, observed that the accused had been indicted in FIR No 129 of 2015 for the commission of offence under sections 363, 376 and 147 of RPC and bare perusal of the section 497-c(3), makes it manifest that the provisions of anticipatory bail under section 497 of CrPC were not applicable to section 376 of RPC.
With these observations, the court rejected their pre-arrest bail applications. |
