Implementing Authority cannot go beyond appointing Authority: HC | | | Early Times Report
Jammu, Dec 8: A High Court division bench of Chief Justice N Paul Vasanthakumar and Justice Bansi Lal Bhat today held that implementing authority could not go beyond the selection committee as well as the government which is appointing authority. The counsels submitted that petitioner Darshan Lal had applied for the post of assistant programmer in finance department under SC category. He was duly selected by the Service Selection Board and appointment order was also issued. However, when he went to the office of deputy director, accounts and treasuries, Jammu, he was not allowed to join. He then filed the writ petition before the high court. The single bench had held that Deputy Director had no jurisdiction to go into the validity of the certificate possessed by the petitioner. It had also given the finding that the action of the deputy director was discriminatory and arbitrary. With these observations, the division bench upheld the judgment of the writ court. (JNF) |
