NT locks Niabat office, refuses to hand over keys | Fight over post of NT escalates in Kishtwar | | Asif Iqbal Naik

Kishtwar, Dec 12: Even though the J&K High Court issued stay order on the transfer of Naib Tehsildar Kishtwar Mehraj-ud-Din on medical grounds, the controversy surrounding over the denying of charge by the incumbent Naib Tehsildar Kishtwar Aziz Mohammad who assumed the charge of the office of Naib Tehsildar Kishtwar before the HC granted stay on the transfer of Mehraj-ud-Din sparks a major controversy today when Tehsildar Kishtwar showed his ignorance over the assuming of charge by new Naib Tehsildar Kishtwar, added that Aziz Mohammad has assumed the charge of Naib Tehsildar Kishtwar without intimating to him by breaking the locks of Naib Tehsildar Kishtwar office. As per the details available with "Early Times", Tehsildar Kishtwar vide order No. 373-77/TK/N/15 Dated 12-12-2015 stated that Mehraj-ud-Din Naib Tehsildar Kishtwar was transferred from Niabat Office Kishtwar to Naibat Office Marwah and Aziz Mohammad NT Pathernaki to Naibat Office Kishtwar vide Govt. Order No. 169-Rev of 2015 Dated 2-12-2015 whereas Mehraj-ud-Din NT Kishtwar was on deputation to Office of the Vigilance Organization Jammu vide this office Order No. 883-85/STS Dated 3-12-2015 and Aziz Mohammad NT Pathernaki assumed the charge of Naibat Office Kishtwar without following proper procedure I.e without submitting the joining report in the office of the Tehsildar Kishtwar (DDO) and broke the locks of Naibat Office Kishtwar and started his official work. The order of Tehsildar Kishtwar further stated that in the mean time HC Jammu wing has order in SWP No. 3141/2015, MP No. 1/2015 dated 7-12-2015, that the government order No. 169-Rev of 2015 Dated 2-12-2015 shall not be carried on to the extent it pertains to Mehraj-ud-Din Naib Tehsildar Kishtwar till some decision is taken by the government in light of the facts mentioned in the petition. Tehsildar Kishtwar while implementing the HC order directed NT Mehraj-ud-Din to continue as NT Kishtwar till any decision is taken from the higher authorities, but to the irony as per Tehsildar Kishtwar the NT Aziz Mohammad despite repeated request has locked the court room and did not hand over the keys of the said room as a result of which the government as well as the public works suffer badly. "In view of the above facts and as desired by DC Kishtwar, the above mentioned order of the High Court Jammu wing should be strictly implemented in letter and spirit as the non compliance of the HC order will be the contempt of court. As such Aziz Mohammad is directed to handed over the keys of Naibat Office Kishtwar to Mehraj-ud-Din and Mehraj-ud-Din Naib Tehsildar Kishtwar is directed to start his official work without any further delay" read Tehsildar Kishtwar order, but despite clear cut orders from Tehsildar Kishtwar no keys were handed over by the NT Aziz Mohammad to Mehraj-ud-Din. It is pertinent to mention that in a significant development after full bench judgment of Jammu and Kashmir High Court comprising Chief Justice N P Vasanthakumar, Justice Hasnain Masoodi and Justice B L Bhat wherein court on August 31st, 2015 held that Government can transfer its employee at any time notwithstanding the fact that employee has not served for minimum of two years at a particular Station or post, the single bench of Jammu and Kashmir High Court stayed the transfer of Naib Tehsildar Kishtwar on medical grounds and directed the respondent Commissioner Secretary to Government Revenue Department and Deputy Commissioner Kishtwar to allow the petitioner (Naib Tehsildar Kishtwar) to continue on present place of posting and kept the order No. 169-Rev of 2015 Dated 02-12-2015 to the extent it pertains to petitioner in abeyance. |
