JACGC stages protest, demands implementation of HC judgment

Kathua, Dec 13 : Joint Action Committee of General Category District Kathua unit in collaboration with many social organizations like Patanjali Peeth, Rajput Sabha, Brahman Sabha, Sikh Youth Welfare Society, Trade Union etc staged massive protest demonstration through a protest rally that commenced from Bhagat Singh Park and moved through the entire city. Joint Action Committee, JAC sought implementation of High Court's direction wherein through a decision, Court denied reservation quota in Departmental Promotion Committee in government sector. The JAC said justice delayed is justice denied and laid down focus on reservation in promotions is a great injustice to employees in seniority. JAC recommended reservation for upliftment of society but when they get government job, they must consider in general category as they don't need more reservation. Addressing a huge mass of people on the occasion Convener Ankur Sharma said Reservation in promotions is 'Reservation within Reservation' which affects the equality code indicated in Articles 14, 15 and 16 of the Constitution. He added that Equality of opportunity doesn't mean equality of outcome. Reservation in promotions seeks to achieve equality of outcome which is against the basic structure of the Constitution. Article 16 (4A) which is the enabling provision for allowing Reservation in promotions is not applicable to the State of J&K and finds no mention in the Constitution of J&K. Representatives of all General Category Sabhas and Biradaris vociferously attacked the political parties taking sides on the basis of vote bank politics and undermining judiciary and judicial independence. The Committee also seeks the support of intellectuals, social workers, other activists and people from every strata of the society in National Interest. The committee firmly believes that in the absence of an efficient administrative setup, eradicating backwardness and poverty will remain a distant dream. Ankur Sharma said that if the Government fails to implement the judgment of the High Courts or even attempts to bring an ordinance or a constitutional Amendment overriding the High Court judgment, Joint Action Committee would further intensify its movement for the sake of national interest further told, adding that if other states can abolish reservation in promotions, why the state of J&K can't move in the same direction that too after the High Court judgment.
