Cyber-cafe owner denied bail in rape case

Jammu, Jan 18: Third Additional Sessions Judge Kishore Kumar today rejected the bail application of a cyber café owner in an alleged rape case. A girl had lodged a complaint against Sidharath Suri, son of Rajinder Kumar of Lower Mast Garh, alleging therein that she was raped by him. The accused runs a cyber café under the name and style of 'My Place' at Kachi Chhawni, opposite Ranbir Library. The victim used to visit the café for filling up forms and scanning of documents. When she visited the café a few months back, the accused allegedly raped her and took her nude photos, threatening her to make them public if she ever disclosed the incident to anybody. He also allegedly took all her documents and ATM card. The accused and his family members had also pressurized her parents for marriage. She had not disclosed the incident to her parents till her obscene photos were sent by the accused to her brother on his mobile phone. On the receipt of this report, police lodged FIR No 197/2014 for the commission of offences under sections 376, 294 and 506 of RPC. After the completion of the investigation, offences under sections 376, 294, 292, 382, 506 and 354 of RPC were prima facie proved against the accused. After hearing the two sides, the judge observed that offences allegedly committed by the accused carried punishment of life imprisonment and being serious in nature, it was considered to be a menace and threat to society as a whole and the accused resorted to such activities which demean the psychological development of a woman. "Rape is not only a crime against women but it is a crime against the whole society. No doubt personal liberty guaranteed to the accused is undoubtedly his valuable right under Article 21 of the Constitution but the same can be refused in accordance with the procedure established under law," he observed. With these observations, the court rejected the bail application of the accused.
