HC issues guidelines for mobile courts | | | Early Times Report Jammu, Feb 17: A full court meeting held under the chairmanship of Chief Justice N Paul Vasanthakumar has issued circular for the guidance of presiding officers of Mobile Courts, their staff, the staff from prosecution wing and the concerned department associated with on the spot trials. A circular issued by registrar general M K Hanjura said the court staff, ie orderlies and other ministerial staff accompanying the presiding officer should in no case get associated with the staff of Prosecution Wing or the concerned department to detect violations and bring the violators before the mobile court. The court officials are made aware of the fact that they have no role in prosecution and their role begins only when a challan or charge sheet is presented before a mobile court for the spot trial. The circular said that presiding officer shall in no case allow him/her Personal Security Officer (PSO) to play any role in detection of violators presenting challans/charge sheet or their disposal or receipt of the fine imposed. The only role of a PSO is to ensure that security of the presiding officer is not compromised and take steps in this regard and checking and spot trials should be conducted and mobile courts held at places where such checking and spot trials do not disrupt traffic or cause inconvenience to the general public. The traffic police is directed to ensure unhampered movement of ambulances and other public utility vehicles during the spot trials. —JNF |
