Early Times Report Jammu, June 14: Due to the failure of prosecution to prove the case against a man, who was allegedly involved in the preparation of fake PRCs, principal sessions judge, Kathua, Sanjay Dhar has ordered his acquittal. In his letter No 988-89/M addressed to SHO of Police Station, Kathua, the tehsildar stated that one Surinder Kumar, son of Janak Raj had produced three photocopies along with three original PRCs (Permanent Resident Certificates) for attestation on August 17, 2011. He alleged that his signatures as an attesting authority and the signatures of issuing authority dis not match. It was also reported that as per the record of the office, no recommendation for the issuance of PRC had been made to the competent authority. The letter said Surinder Kumar had stated that he had managed to get the said certificates through accused Raj Kumar, son of Govind Ram of Falote, Kathua, by paying him an amount of Rs 10,000. On the basis of this letter of tehsildar, Kathua, police registered FIR No 286/2012 for offences under sections 420, 467, 468 abd 478 of RPC. The judge, after hearing both the sides, observed that the failure of prosecution to prove the facts was the result of inefficient and half-hearted investigation conducted by the investigating agency. "It seems that the investigating agency has, somehow, felt reluctant in questioning then additional DC, Kathua during the investigation of the case. The fact that IO has felt reluctant in recording the statement of even a middle rung officer of the rank of additional DC, bodes ill for the investigating agencies of our state. It is high time that superior officers in the investigating agency encourage IOs to question and examine all those persons who seem to be acquainted with the facts of a case irrespective of their stature and standing because they are obliged to discharge their duties in accordance with the provisions contained in Code of Criminal Procedure," he said. With these observations, the court acquitted the accused. |
