Anganwari worker's appointment kept in abeyance | | | Early Times Report
Jammu, June 22 (JNF): High court vacation judge B S Walia today directed to keep in abeyance the appointment of an anganwari worker. The court directive came in a petition filed by one Neelofar, challenging the appointment of Jaspreet Kour as anganwari worker. The petitioner's counsel stated that as per norms, any person aggrieved with the selection of anganwari workers was entitled to file an appeal before the deputy commissioner within 30 days from the date of their selection and on receipt of objections, he was to decide them within 15 days after conducting an enquiry and if still aggrieved, the petitioner had the right to approach the revisional authority whose decision would be final. He stated that Jaspreet had been selected for anganwari centre, Christian Colony in Pouni, Reasi, whereas she was not actual resident of Christian Colony and as per the January 21, 2010, advertisement, the candidate for engagement as anganwari worker must be permanent and actual resident of the hamlet for which the engagement was sought and it was only if suitable candidate was not available in that hamlet, candidate from the village for which selection was to be made could be considered for selection. He stated that the petitioner had already filed objections within the 10 days on June 15, 2016 although the said period was required to be 30 days. The apprehension of the petitioner was that Jaspreet would be appointed without deciding the said objections. "The petition is taken on board and is disposed of with a direction to DC, Reasi, to consider and decide the June 15, 2016 objections as expeditiously as possible preferably within two weeks from the date the certified copy of this order is produced before him. Petitioner, if still aggrieved, will be at liberty to approach the revisional authority within 15 days of the DC's order. The divisional commissioner in terms of applicable government order will be required to decide the same within one month thereafter and his order in the matter will be final," Justice Walia said after hearing the counsel. He ordered to keep in abeyance the appointment of anganwari worker till the petitioner's objections were not decided by DC, Reasi, or the divisional commissioner as the case may be. |
