HC orders status-quo on closure of stone crusher | | | Early Times Report Jammu, June 23: High court vacation judge B S Walia today ordered status quo on the closure of a stone crusher till the next date of hearing and filingof objections by the state pollution control board (SPCB). The court directive came in a petition filed by the owner of M/s Sharma Stone Crusher, challenging the SPCB notice as regards the closure of the unit. It was stated that the crusher was operational since 1987. Justice Walia, after hearing the petitioner's counsel, issued notice and directed the respondent to produce the record on the basis of which impugned order was passed that the unit had been operating in violation of the provisions of law. It was submitted that the bonafide of the petitioner could be vindicated from the fact that he, during all this period of operation of his stone crusher, had possessed consent certificate from SPCB, thereby vindicating any concern for the sustainable development of the state and its people without fiddling with the environmental cleanliness or infringing the fundamental rights of the citizens of the state by taking utmost care in not polluting the environment and taking all necessary measures to keep it clean, hygienic and pollution free. Justice Walia, after hearing the counsel, ordered status quo on the closure of the unit till next date of hearing and filing of objections by the respondent. |
