Govt deptts emerge major violators of building norms in twin capitals

SRINAGAR, July 1: While the Government agencies continue to blame and penalize people for master plan violations, it itself has proved to be main violator by failing to seek permissions time to time from the competent authorities for raising departmental constructions.
Hundreds of constructions have been raised in the Jammu and Kashmir over the years especially in Srinagar and Jammu cities in violation of the master plan, building by laws and other regulations.
Earlier this year after the intervention of High Court, the government launched a drive against the violators and sealed many shopping complexes and hotels which were raised in violations of the rules. However, official sources said there are hundreds of government buildings constructed over the years without permissions throwing rules and regulations to wind.
According to a circular issued by Housing and Urban Development Department (HUDD) to departments says that government departments, organizations and PSUs which are in need of renovating their offices or constructing new buildings are not seeking permissions from the competent authorities. "It has been observed that such constructions are mostly in contradiction to the existing master plans of cities, towns and rules by laws in vogue," the circular reads.
"Now therefore all the government departments, organizations are hereby enjoined upon that the construction, renovation of any building be initiated only after getting the plans of buildings approved from the competent authorities and after paying the requisite fee," it reads.
The directions according to officials have come in view of the master plan violations not only by the people but by the government departments of which many are regulatory bodies for implementing laws. "Government has been often blaming the people but most of its new buildings constructed over the years have not been approved by the competent agencies. There are also some government constructions which have been raised on the flood channels, and notified areas," an official of HUDD department told Early Times.
The SMC, LAWDA and other agencies had demolished scores of constructions in Srinagar which were raised after the 2014 floods. However, these agencies have maintained silence over the government buildings that have been raised in violations of the rules. Earlier a government committee in 2014 had identified around 2,000 to 3,000 structures constructed in violations of rules in Srinagar alone. "But no survey has been conducted over the government buildings constructed in violations of the rules," the official said.
There is no doubt that the main cause for violations of the previous master plan has been corruption but yet one cannot overlook the violations committed by the Government itself. "There is hardly any department of the government that has not violated not only the land use policy, but the building bye laws and above all the master plan itself," he added.
