Revival of defunct SHRC: HC seeks compliance report by Sept 5 | | | Early Times Report Srinagar, Aug 10: The High Court has sought the compliance of its directions on reviving the defunct State Human Rights Commission by September 5. Additional Advocate General M I Dar produced before a division bench of the court a commission by Special Secretary Law Department, addressed to Advocate General, stating that in view of the present scenario, the meeting of the selection committee could not be convened. He so sought time from the division bench comprising Chief Justice N Paul Vasanthakumar and Justice Ali Mohammad Magray which granted the government time and posted the matter on September 5. The court was hearing a Public Interest Litigation and last year it had directed the government to appoint the Chairperson and four members of the commission "strictly" within the time limit of November 10. "The time limit mentioned has to be strictly adhered to as the stand taken by the (government) in the objections filed on 06 October 2015 is that the appointment of chairperson and the members of the SHRC is under its active consideration," the division bench had said. Among others, the SHRC is empowered to inquire, suo moto or on a petition presented to it by the victim or any person on this behalf, into complaint of violation of human rights or its abetment; or negligence in the prevention of the violation by a public servant. It can also intervene in any proceeding involving any allegation or violation of human rights pending before a court with the approval of such court and visit any jail or any other institution for purposes of treatment, reformation or protection to study the living conditions of the inmates and make recommendations. |
