A month after HC stay, Biometric attendance still compulsory in various departments | | | GS Asgotra Early Times Report Jammu, Nov 6: After the lapse of over one month since Jammu and Kashmir High Court had stayed the Aadhaar based biometric attendance in government departments, the biometric attendance is still compulsory in various government institutions, in violation of High court directions. Pertinently, the division bench of Chief Justice N Paul Vasanthakumar and Justice Ali Mohammad Magrey on October 4, while referring to Supreme Court and state High Court orders on Aadhaar, had stayed the state government's order making it mandatory for its employees to procure Aadhaar cards for Aadhaar based biometric attendance in government offices. Officials working in various Government degree colleges, government departments informed Early Times that despite High Court orders, there was no change in the attendance system. "We are still marking our attendance on biometric system, where Aadhaar card is compulsory as the attendance system, cannot trace the fingerprints until the aadhar card number is not enter there", an official said, adding that if the High Court has already stayed the Government order, then it was very unfortunate that the practice was not stopped immediately. On February 2, this year the state government by an Order (35-F of 2016) had made Aadhaar mandatory for Government employees, pensioners and other such people, and the order was quashed. In some of the offices, headquartered at capital city, the Aadhaar based biometric attendance is still compulsory while in the districts, the practice is not in practice. "The heads of these institutions are reportedly hesitating to stop the practice as the state government had introduced the biometric attendance system with much fanfare and stop this practice, may invite wrath of some politician on the head of institution", sources said, adding that apprehending such repercussions, none of the head of institution was taking a call on the system. If the Supreme Court as well as High Court had stayed the move, then why not a call is taken by the government itself, an official said, adding that it was open violation of Supreme Court order as well as High Court order but government is not adhering the orders of courts, which is very unfortunate. The state government itself to take a call as per the directions of Jammu and Kashmir High Court as well as Supreme Court so that all the heads of government institutions will take a call on the system, an official said, adding that if there would be no direction from government, the system would run partially as usual. |
