3 months on, cases remain unheard in Labour Court
New judge not delegated powers

Jammu, Nov 7: More than a hundred cases are pending with the Labour Court Jammu for the last three months due to non-delegation of powers to the new judge by the Law Department.
The new judge took over in August, but since then not a single case has been heard or disposed off.
"The casual approach of the Law Department which failed to issue SRO in this regard since August has virtually brought the work of the Labour Court to a standstill. Due to inability of the judge to hear cases, the labour class has been facing huge difficulties," sources added.
Astonishingly, the Labour Department, which is the major stakeholder of the laborers' welfare, has miserably failed to put pressure on the government particularly the Law Department to issue notification in this regard so that the functioning of the Labour Court could start.
"The delay in delegation of powers to the judge is not a new phenomenon. It has been a routine in the past also, but the department concerned never showed any concern to sort out this issue for good. It is shocking that the same problem also existed in the Revenue Department particularly in the transfer and appointment of tehsildars due to which the process for getting Permanent Residential Certificate (PRC) generally gets hampered, as new the tehsildar was also not delegated powers at the time of appointment," sources said.
Things become more difficult for the laborers, as the lone Labour Court judge has to look after both regions of the state with 15-day stay in Jammu and equal time period in Kashmir which gives a little time for the hearing the cases due to which hundreds of cases are lying pending.
Interestingly, the delay in delegating the power to the judge generally takes five to six months. But at many occasions it has been observed that the judge awaiting powers get transferred and the new judge faces the same problems.
