Early Times Report Jammu, Nov 9: High court judge Tashi Rabstan today quashed the PSA of a juvenile who was apprehended for his alleged involvement in an attack on a Kashmir-bound truck at Udhampur some time back. The government had slapped PSA on Sunit Singh, a juvenile. After hearing the two sides, he said the detenue was entitled to the benefit under J&K Juvenile Justice (Care and Protection of Children) Act, 2013 since he was a juvenile on the date of commission of the offence. With these observations, the court allowed the petition and the impugned order of detention bearing order No Home/PB-V/255/2016 dated April 15, 2016 was quashed. The court also directed respondents to release the detenue from preventive detention, if not required in any other case, with a direction that he be given the treatment as was given to the juveniles under the J&K Juvenile Justice (Care and Protection of Children) Act, 2013. "Miscellaneous petition(s), if any, accordingly stands disposed of," the court directed. (JNF) |
