Jammu, Dec 16 : In a petition filed by the secretaries of Chief Justice, seeking initiation of contempt proceedings against respondents for non-implementation of a high court judgement that held that CJ's secretaries are entitled to grade equivalent to KAS, a HC division bench today said that a proposal submitted by the court pursuant to the division bench directions 'states that sanction to the creation of said posts be accorded with effect from December 2008'. The bench of Chief Justice N Paul Vasanthakumar and Justice Tashi Rabstan, after hearing the two sides, observed that the senior AAG had produced government order No 3398-LD (A) according sanction to the creation of two posts of secretaries in the selection grade and three posts of secretaries in the special scale with effect from the date of passing of order, December 13, 2016.
Upon this, the bench said that proposal submitted by the high court pursuant to the directions given by the division bench 'states that sanction to the creation of said posts be accorded with effect from the date when the incumbents became eligible for the upgraded scales, ie December 1, 2008. The bench granted two week's time to modify the government order No 3398-LD (A) of December 13, 2016.(JNF) |
