HC issues show cause notice to Div Com Kashmir | Coaching Centre Row | | Early Times Report
Srinagar, Apr 7: The state High Court today issued show cause notice to Divisional Commissioner Kashmir, asking him to file reply within three days as to why action under rules shall not be initiated against him for non-compliance of its orders. "In order to maintain majesty of rule of law and majesty of courts, the Divisional Commissioner Kashmir to show cause why action in accordance with law be not initiated," said a division bench of the court comprising Justice Muzaffar Hussain Attar and Justice Ali Mohammad Magrey. The bench also directed the Committee headed by Divisional Commissioner, constituted by the Court December 30 last, to close all the unregistered coaching Centre. "The compliance report be filed within three days time before the registry failing which, the Divisional Commissioner Kashmir shall appear in person on April 11," the bench added. The court passed the directions after perusal of the compliance/affidavit filed by the Divisional Commissioner Kashmir, stating that no action could be taken upto April 2 because six weeks time was granted by the Supreme Court to the owners of Coaching Centres. He further submitted that action could not be taken due to flood situation in the Valley. In Jammu Division, the court was informed that most of the unregistered Coaching Centre have been closed by the authorities. Sunil Sethi, Senior advocate, submitted that to his information some unregistered coaching centres in Samba and Rajouri have also been closed by authorities. In Jammu district, about 96 unregistered coaching /tuition centres have been closed by the Authorities. "Director school Education Jammu shall accord registration to such tuition centres who have filed application prior to the court order dated 30 December 2014 and whose coaching centres would be registered shall be de-sealed after their registration and after ensuring there is compliance of the court order," the court said. Meanwhile, the court also extended time till April 27 to a panel comprising two retired judges for filing its report. On February 10, the court had directed, besides the closure of the coaching centres, the constitution of the committee comprising two former District and Sessions Judges to verify undertaking filed the owners of these centres before the Registrar Judicial of the court. The High Court had also directed the coaching centres in Srinagar to deposit an amount of Rs 10,000 each while those operating in other districts of the Valley were directed to deposit Rs 7000 with Registrar Judicial within ten days time. The amount, as per the court, is to be paid to the members of the committee in equal share. However, the Supreme Court granted six weeks to the coaching centres even as it dismissed their challenge to the high court order about the depositing of the money. |
