Fee-fixation in schools: DB asks Com/Secy Education to appear in person on July 20 | | | Early Times Report
Srinagar, July 14: Coming down heavily on School Education Department on fee collection issue, a Division Bench of J&K High Court comprising Chief Justice N Paul Vasanthakumar and Justice A M Magrey directed Commissioner/Secretary Education to appear in person on July 20 to explain why he should not be punished for not nominating retired judge for the fee fixation panel in the state. While hearing a contempt petition, a Division Bench rejected an application filed by Shaleen Kabra, Commissioner Secretary to Dtate's education Department, seeking further extension in time for reviving the fee fixation panel in the state. Taking strong notice of state government for not mentioning any compliance with the court directions in the application, the Division Bench said, "Respondent No 1- Commissioner/Secretary Education Department is directed to remain present in person on next date of hearing i.e. on July 20 to state the reasons as to why he be not punished for not complying with the directions issued by the court. Earlier Division Bench had directed the government to nominate a former judge of the J&K high court as chairman of the committee set up in 2013 to fix fee structure of private schools in the state. The court also made it clear to private schools that there was no question of reopening the issue with regard to the payment of fee for the month of September and October. "The fee for the September and October was to be collected by the schools managements only after getting clearance by a committee headed by a retired judge of this court. The panel was ordered to be constituted within one week which the government has failed but it does not mean you will do whatever you want," the Division Bench said, rejecting contention by private schools that a circular issued by the school education department was contradictory to the directions passed by the court while disposing of the PIL filed by Parents Association. In another direction, the court also directed president of Unaided Private Schools Coordination Committee GN War to file statement of facts on the petition, seeking contempt of court proceedings against him. |
