HC issues directives over cancellation of State Subjects of 136 persons | | | Early Times Report
Jammu, Sept 23:The High Court of J&K Jammu Bench comprising of Justice Tashi Rabstan today issued various directions in regard to the challenge to Govt Order no. 101- Rev (PRC) of 2015 dtd 25/6/2015 passed by the Commissioner/ Secretary to Govt. Revenue Department, J&K. When the plea was taken up for hearing, Ahsan Mirza Addl Advocate General (AG) produced a communication of the Revenue Department, Govt of J&K wherein it was informed that the impugned Govt Order whereby Permanent resident Certificates / State Subjects of 136 persons were cancelled has been kept in abeyance by the Govt of J&K vide Order no. 848-GAD of 2015. Advocate A K Sawhney Advocate with Adv Aseem Sawhney submitted that since the impugned Order cancelling the State Subject of petitioner interalia the 136 persons has been kept in abeyance therefore the respondents be directed to file their objections. The Court making observation of the keeping in abeyance of the impugned order has disposed of the Miscellaneous Petition of the Petition but directed the AAG for the State to file objections in the main petition. It may be mentioned that the High Court earlier had issued Notice to the State through Commissioner/ Secretary Revenue Department, Commission of Inquiry also called the State Subject Inquiry Commission headed by retd Justice A Q Parrey and Crime Branch J&K. The Court directed the Addl Advocate General (AAG) for the state to produce the entire record pertaining to the case on the next date of hearing. (JNF) |
