HC rejects bail in murder case

Jammu, Oct 14: A High Court division bench of Justice Dhiraj Singh Thakur and Justice Janak Raj Kotwal dismissed the bail application of Riaz Khan who along with three others were convicted and awarded life-impriosnment by the trial court in a murder case.
According to the police case, a report was lodged on February 17, 2008 by Sher Mohammad Khan at 3 pm with Mandi police station, stating therein that he and the accused hail from the same area and are closely related to each other but had developed strained relations over a piece of land. He said that on the fateful day at about 2 pm, Mohammad Arif Khan, Mohammad Zaman Khan, Riaz Ahmed Khan, Mohammad Maqsood Khan, Sakina Bi, Mushtaq Ahmed Khan, Mohammad Shafeeq Khan and Abdul Rashied Khan with common the criminal intention to commit murder at the instigation of Mohammad Shafi Khan and Abdul Rashied Khan, attacked him, his sons - Mohammad Farooq, Mohammad Qayoom, Mohammad Javed -- and other family members in front of their house with lathies, iron pipes and axes. Mohammad Zaman inflicted axe injury on the head of his son Mohammad Farooq, resulting in his death, when the other accused started beating him and his family members.
On this, FIR No 7 was registered for commission of offence under sections 302, 147, 148, 149 and 109 of RPC at mandi police station.
After completion of investigation, challan was presented which was decided by the trial court and the trial court awarded life imprisonment to all the accused.
Rejecting the bail application, the bench observed that "We, in order to accord consideration to applicant's prayer for release on bail, have read the evidence on record of the trial court and having done so we are not persuaded to take a view that a case for releasing the applicant on bail at this stage is made out.
We, however, will not dilate much in the matter so as to avoid any aspersion on the merits of the appeal."
With these observations, the court rejected the bail application. (JNF)
