Jammu, Nov 9: In an appeal filed by Huseena Bano challenging the writ court judgment whereby it had quashed her appointment and directed respondents to appoint Gulshan Ara as Anganwari Worker, a high court division bench of Chief Justice N Paul Vasanthakumar and Justice Tahsi Rabstan today set aside the order while allowing the appeal. The bench, after hearing both the sides in view the report of Deputy Commissioner, Kupwara and the fact that appellant-writ respondent is resident of Panch Ward No.6, Shah Mohallah and is having higher merit than writ petitioner, said the appeal merits to be allowed. Accordingly, the appeal is allowed and the judgment/order dated 08.04.2014 passed by the Single Judge in SWP No 1933/2012 is set aside. Consequently, the order issued by the Child Development Project Officer, ICDS, Kralpora under April 26, 2014 endorsement No CDPO/KLP/Estt/14/51-55, cancelling the engagement of appellant Huseena Bano and in her place engaging Gulshan Ara as Anganwadi Worker is hereby quashed and directed official respondents to take Huseena back in service forthwith. The bench also directed that she will be entitled to all consequential benefits. (JNF) |
