File ATR in alleged 'unauthorized construction' by Ex Minister: HC to Com JMC 12/3/2015 10:42:33 PM Early Times Report Jammu, Dec3: In a petition seeking directions to Commissioner Jammu Municipal Corporation (JMC) to perform its statutory duties under J&K Control of Building Operations Act (BOCA), 1998 by initiating appropriate action against Former Revenue Minister for raising illegal construction at Deeli, Jammu in violation of the approved plan, the Justice Bansi Lal Bhat of J&K High Court Jammu Wing today directed Jammu Municipal Commissioner to take action warranted under law in regard to alleged major violation resorted to by Former Revenue Minister Raman Bhalla in construction of his palatial house. Justice Bansi Lal Bhat further directed the JMC Commissioner to file Action Taken Report within three weeks. After hearing counsel appearing for petitioner, Justice BL Bhat issued notices to the Commissioner/Secretary GAD, Commissioner/Secretary Housing and Urban Development Department, Commissioner JMC and Former Revenue Minister Raman Bhalla returnable within three weeks. While directing to JMC Commissioner, Justice Bansi Lal Bhat observed that petitioner has filed this petition after failure on the part of Commissioner, JMC to exercise its statutory power under J&K Control of Building Operations Act, 1988 which has chosen to act as a mute spectator closing its eyes to the flagrant violation indulged into by the former Revenue Minister who has constructed a residential house at Deeli, Jammu. Court further observed that counsel has submitted that since Raman Bhalla had been a Cabinet Minister in the previous regime, it is because of the influence and political clout enjoyed by him that the Municipal Commissioner Jammu is reluctant in taking any action.
