Copy of service book can be provided only in case of larger public Interest: SIC | | | Early Times Report Srinagar, Dec 6: Copy of service book of a Government employee can only be provided under Right to Information Act (RTI) by the Public Information Officer (PIO) when he is satisfied that the said information involves larger public interest. The J&K State Information Commission (SIC) issued this order while disposing off a second appeal filed by a retired Government teacher after he was denied the said information by the Chief Education Officer (CEO) Shopian . Details available with Early Times reveal that one Abdul Qayoom Khan a resident of Nishat Srinagar filed a second appeal before the State Information Commission (SIC) on 09.10.2015 stating that he requested CEO Shopian vide RTI application dated 01.07.2015 for providing information, which mostly pertained to his service record. The PIO according to Khan failed to provide him the information within stipulated time. Khan alleges that CEO Shopian asked him to deposit Rs 12,000/- without mentioning any account number. Information seeker Abdul Qayoom Khan had sought information on 22 points. Thereafter, while filling his first appeal on 28.08.2015, he limited his information to eight points only. This has been admitted by Abdul Qayoom Khan (Appellant) in his second appeal filed before SIC. The CEO in his communication dated 19.09.2015, has given response to all the 22 points of the RTI application. Khan, admitted to have received this information, but submitted that information in respect of some points has not been provided to his satisfaction. CEO alleged that information consisting of more than 3000 pages has been provided to the applicant from time to time and was dispatched by speed post to him. The CEO submitted before SIC that the information for which the appellant has approached to State Information Commission has been sent to him by post with copy to Director School Education Kashmir under letter dated 19.09.2015. SIC order in its order ruled, "At Point 17, the appellant has sought service book of one teacher Mohammad Ishaq Dar. It is held that the service records of an employee are the personal information and cannot be disclosed unless the information seeker establishes that such disclosure is in the larger public interest. Since no such case has been put forth before the Commission, the information sought at point cannot be disclosed". |
