Prosecution failure leads to acquittal in kidnapping, rape case | | | Early Times Report
jammu, Dec 9: Fast Track Court Presiding Officer Y P Kotwal today ordered the acquittal of Ajit Raj alias Kaka who was facing trial in kidnapping and rape case after the prosecution failed to prove its case. The brief facts of the prosecution case are that on January 9, 2012 while the prosecutrix was going to her stitching centre at Purkhoo, Kaka, who was known to her, met her at Garhi Chowk at about 11.15 am and offered her a lift on his motorcycle. When the girl sat on the pillion seat of the motorcycle, the accused, instead of dropping her at Purkhoo, brought her to Jammu, allegedly threatening to kill her in case she raised an alarm. From Jammu, he took her to Katra and then to the holy cave shrine of Mata Vaishno Devi in Trikuta Hills. They came back to Katra next day and stayed for the night in a Guest House where the accused allegedly raped her. On January 11, 2012, the accused came back to Jammu and after dropping her at Jewel Chowk, fled away. In the meanwhile, she met her brothers -- Tarsem Lal and Tara Chand -- who took her to Kanha Chak Police Station and lodged a complaint against the accused. Accordingly, a case under sections 366, 376 of RPC was registered against the accused and after investigation, offences punishable under sections 366, 376 of RPC were made out against the accused. The court, after hearing the two sides, observed that that the prosecution had failed to prove its case against the accused beyond reasonable doubt. Hence prosecution case is dismissed and accused Ajit Raj alias Kaka is acquitted of the charge levelled against him, the court ordered. -(JNF) |
