Ex-revenue minister moves court against JMC's move to demolish his house | Court issues notice to JMC for reply | | Early Times Report
Jammu, Jan 16: Against the JMC's proposed move to demolish his house at Deeli here this morning, the ex-revenue minister hurriedly moved the court of special municipal mobile magistrate M R Chak and filed a lawsuit for adjudication. The house is alleged to have been construction in violation of the approved site plan and building laws. After hearing the ex-minister's counsel, the judge issued notices to the JMC Commissioner, Joint Commissioner (adm), Khilafwarzi Inspector Naresh Kumar and Chief Khilafwarzi Officer Kamini Kesar as to why the relief prayed for in the application for temporary injunction be not granted in favour of the ex-revenue minister. JMC standing counsel, however, sought time to file objections to the application of the ex-minister whose counsel submitted that the matter was already pending before the J&K High Court where the petition was coming up for hearing on Monday before the vacation judge. After hearing both the sides, the judge granted time to the counsel for filing objections to the suit filed by ex-minister and fixed the matter for January 19 next. In the civil suit, the ex-minister alleged that despite the pendency of the matter before two forums -- High Court and J&K Special Tribunal -- to his utter surprise, JMC was hell bent to take law in its hands and was going to demolish his entire residential house taking advantage of the non-listing of the matter before the high court. He alleged that the JMC had even approached SSP, Jammu, in writing and sought police assistance for carrying out the demolition of his residential house at 10.30 am today. He alleged that JMC officials yesterday came to his house and directed him and his family to vacate it by tomorrow for commencing the demolition process by 10.30 am on Saturday. He said while he immediately approached the JMC office and apprised that matter was sub-judice before the courts and propriety demanded that till its outcome, JMC should refrain from taking out demolition process, his request was flatly turned down. Under the prevailing circumstances, he had no option except to approach the civil court for restraining JMC from carrying out demolition of his residential house. --(JNF) |
