Couple denied bail in rape case | | | Early Times Report
Jammu, Feb 19: Reasi CJM Kamlesh Pandita has rejected the bail applications of Romesh Lal and his wife Rajinder Kour who were arrested by police in a rape case. In a written complaint lodged with police on January 18, 2016, the victim, who is an educated woman, stated that since Romesh and Rajinder Kour knew her in-laws, they demanded Rs 3 lakh from her mother-in-law to get her appointed in a government department. On January 17, 2016, Romesh came to their residence at about 1.30 pm and took her with him for handing her the appointment order from some 'saheb'. She said he took her to Akhnoor, where she was taken to an unidentified vehicle in which Rajinder Kour and the 'saheb' were already sitting. She was made to sit in the vehicle which was taken to an unknown place, where Kour allegedly asked her to entertain the sahib so that appointment order was obtained. The sahab then committed rape on her, she alleged. Kour later, using cellphone of the sahib, called Sunny and Bunty to Jhiri. The two, who were on a motorcycle, frightened her with a 'toka' and forced her to accompany them. She alleged that the two motorcyclists also raped her. She was later left alone at Jhiri where she met two persons, one of whom called up her home. After getting the phone call, her mother-in- law came to Jhiri and took her home. The matter was brought to the notice of concerned police station the next day. The CJM, after hearing the CPO, observed that the investigation of the case was in progress and the allegations levelled against the accused were very serious. Bail was a general rule and its denial was an exception to the general rule. In this case, the allegations were very serious and considered to be a menace as well as threat to the development of society. "Such offences are not being taken in good taste by the prudent mind of society, so the liberty of any individual person is to be balanced with that of the impact of the offence on the society. Sexual violence apart from being a dehumanisation act is unlawful in terms of the right of privacy and sanctity of a female. It is a serious blow to her supreme honour and offends her esteem and dignity. The crime of rape is not only a crime against the person or women, but it is regarded as crime against the whole society. Personal liberty guaranteed to the accused is undoubtedly their valuable right guaranteed under Article 21 of the Constitution, but it can be refused to the accused in accordance with the procedure established under law," the court said. With these observations, the ourt dismissed the bail application of the accused. (JNF) |
