2 get 2-yr RI for making obscene video | Court also passes strictures against IO | | Early Times Report Jammu, Mar 4: Principal Sessions Judge, Udhampur, Rakesh Sagar Jain today awarded two years rigorous imprisonment to two persons for making obscene video of a married woman. According to police case, Chankar Singh filed a report with Ramnagar police station, stating therein that his daughter was married seven years ago to Mangal Singh of Piala, Ramnagar, and three children were born out of the wedlock. He stated that on September 13, 2013, he received a telephonic message that his daughter had died due to drowning. He went to Piala same day at 4 pm and at 6 PM, his daughter was cremated. He said he later heard rumours that there was a conspiracy behind her death. He also heard that someone had made an obscene video of his daughter and for this reason, her death had taken place. During investigation, police came to know that the woman called up Kaka Ram to come to Ramnagar on July 18, 2013. They met at Ramnagar bus stand at 10 am and thereafter went on Dalsar road and then near a nallah at Thil. There, they took off their clothes and were about to indulge in a sexual act when the accused arrived there and abused them. While accused Manohar Lal, son of Makhan Lal of Kanah, took obscene video of Kaka Ram and the woman, accused Kiran Kumar, son of Vishwa Nath of Kanah, took photographs of the woman, forcing her to undress and indulge in obscene act with Kaka Ram. Thereafter, Kiran used to call her occasionally on her telephone. On September 12, 2013, the woman telephoned Kaka Ram at about 2.30 pm and informed him that the obscene video made by the accused had been uploaded on WhatsApp. She said since it was also known to her family members and relatives, she was under mental pressure and did not want to live as she felt humiliated and was going to commit suicide. Thereafter, she committed suicide by jumping into the pond. The accused were then booked under section 306 of RPC and 67 of IT Act and accordingly, the challan was presented in the court. The judge, after hearing both the sides, awarded two years RI to both the accused and also fined them Rs 25,000 each. He said the manner in which investigation was conducted showed lapses committed by the IO and also his lack of knowledge about the investigation procedure which was not expected from a senior officer. "The IO seems to have been ignorant about the basic principles of investigation and information technology and techniques. He did not seem to have any idea as to provisions of law applicable to the facts of the present case and how the case is to be investigated. The case thoroughly exposes the lack of professionalism on part of the IO in carrying out the investigation and also his administrative officers, both in police and legal department, who seem to have passed the challan in a mechanical manner, ignoring the legal provisions and the lapses and inadequate procedure adopted by the IO," the judge said.
